The High Court has just dismissed the Fortescue Metals Group Limited challenge to the Minerals Resource Rent Tax.

Cheers P4S. No surprise there, it was a stupid move on Forest's part in the first place and surely never stood any chance of success. I thought that there was supposed to be a filter system of some sort to stop worthless cases like this one making it past the circular file and letting the courts get on with important work, but it obviously doesn't work too well.

Does Fortescue Mining get to claim their legal fees as a tax deduction?

So far as the High Court is concerned, the exercise of its appellate jurisdiction is by special leave. This writ was issued in the Court's original jurisdiction, so the special leave "filter" isn't available.

Fortescue mining takes legal action with support from the WA & QLD governments.

I want to see WA, QLD & Fortesque mining bang on about Government waste. Wink
