Not likely. This will, I assume, be judicial review of the lawfulness of the ASADA action, rather than a "trial" in the ordinary sense.Doc63 wrote:They reckon they are going to the Federal Court. Its going to get very uncomfortable for some of the major players.

38 players issued with snow cause notices
All 38 have signed statements saying they were injected with Themosin but don't know if it was the A or B kind
The B is the illicit product banned whilst the A is on the WADA list as not fit for human use
The players now have to prove beyond doubt they were not injected with the Themosin B
Players face a mandatory 2yr ban but could be as high as 4yrs
Essendon will pursue legal action but from my understanding they aren't disputing the fact the players were injected with Themosin but it wasn't the illicit substance and they had cleared its with ASADA
Talking tonight with a legal eagle friend he commented they can challenge a few different aspects including the matter wasn't dealt with in a timely manner and that the AFL at the time it is alleged they used the Themosin wasn't a signatory to the WADA code so they are not bound by the WADA code at that time.
He said he thinks they are drawing a long bow legally and it will be a very expensive process for the bombers. He also made he statement the players separately could launch a class action against the club, coaching staff and Dank directly for any loss of income or future health issues that may arise.
He stated the players with the assistance of the AFLPA will be involved deeply as this will be a test case in Australian sport due to the duty of care aspect of what has happened.
I apologize of I have misspelt the illicit drug name

Not infraction notices either...This is just the first step where those involved are given 10 days to show cause why they shouldn't be placed on the shitlist for using banned substances. Infraction notices will only be issued if asada and the afl are not satisfied with the response. Will be in court before we get to that stage anyway by the look.
