She hasn't committed any offences in Australia re drugs. She can publish in another country. Plenty of people have done it. But she has creditors in Australia apparently and he parents will be digging deep.mandy wrote:Not in this country she can't.ronrat wrote:let her do her time if found guilty and sell her story to a publisher. Then she can pay back all her creditotrs including the Australian Government.

It's such a ridiculous and capriciously applied law. Nobody commits a crime so that they can write a prison memoir later in life.mandy wrote:Schapelle says hi.
What happened to her book deal? Her sister's book deal/TV interviews?
FROZEN!
No Australian can profit from crime here, no matter where it was committed. It's against the law.

I disagree. Why shouldn't Schapelle (or whoever) be able to write and sell a prison memoir? She's not profiting off her crime, she's profiting off her ability to write about her imprisonment as a result of it.
I'd rather hear more first-person accounts from criminals than have a one size fits all law like this which doesn't even deter or prevent crime.

Don't we have "no fault" laws when it comes to the TAC and even if a road accident has occurred because of your actions you can still be awarded compensation for injury?
Plenty of media organisations have made money selling magazines or promoting exclusive television interviews because of Corby and her family so I'm not totally against her being able to get on with the rest of her life with them paying something in return.
While I have no interest in her she didn't kill anyone and served far more time imprisoned than she would have if sentenced in this country.
Out of interest are people in this country who after serving a period of time in prison and subsequently found not guilty because of new evidence awarded compensation?
If not then that's far worse than money being given to Corby for her story.
P.S-We do have victims of crime compensation in certain circumstances.

Yes, we have a no-fault statutory compensation scheme in Victoria relating to road accidents under the Transport Accident Act 1985 (Vic). Where an accident has been established and satisfied the requisite elements, the TAC will pay out the applicant.swoop42 wrote:Don't we have "no fault" laws when it comes to the TAC and even if a road accident has occurred because of your actions you can still be awarded compensation for injury?
The same also applies for workplace accidents under the Workplace Injury Rehabilitation and Compensation Act 2013 (Vic)('WIRC Act'), where WorkSafe will pay out the applicant as well if the requisite elements are satisfied.
Applicants can still sue for common law damages in some instances, but most cases are largely dealt with under the relevant legislation, rather than case law.
