This decision might even be incorrect, ie there's a small chance he wasn't really trying to scrape the eyes - and in his case that would be poetic (in)justice!

"As disappointed as we are, we won't do anything further," Matthews said after the hearing.
"We've put forward two very good arguments this week. We obviously felt that the evidence was all in Toby's favour and we're stunned, as a lot of people would be, by the decision tonight.
"But, in the end, that's where we'll leave it. We've got Saturday to focus on and we'll now move on."'
Thank God for some sanity. The Giants are seething with anger so I expect they'll come out in their full violent mode on Saturday. Clearly the dirtiest club in the current AFL. Seriously, they have been pandered to by the AFL for too long. They have a sense of entitlement.
Saturday is a chance for us to show them what a club with a real history is like. Smash the bastards!!!
All our fans should show them what real club support is like. We don't rely on family and friends and rent-a-crowds for our support!

I reckon AFL HQ told him they'd let Toby Boy off. Thank goodness for a truly independent panel of legal eagles who heard the appeal. The Giants' QC was a disgrace!
I wonder if the Toby defenders have switched the charge to "successfully gouging out his opponent's eyes". The charge MC made was just "making Unreasonable or Unnecessary Contact to the Eye Region". At least a third of Neale's face would be what I'd call the eye region (and another third would be in the region of the other eye). And any scraping or plucking motion on any part of an opponent's face deserves a suspension.
Gillies went on and on for over an hour pleading the case that poor diddums Toby was wrongly convicted. But, the Tribunal took less than 15 minutes to chuck the appeal out. In just 15 minutes! Just enough time for the tribunal to pour themselves a round of scotch from the drinks cabinet. Then 'Guilty as charged' they said. 'Hang the bastard!'
