You say I am splitting hairs.

Where am I supposed to go with that other than to say "Your statement is entirely incorrect - the legislation that underpins the current SOE can be extended" ?

Please explain exactly how then?

The explanatory memo says the SOE cannot be extended, (Is Andrews lying?) the legislation has a built in repeal date, it would require a new bill to replace it which is what the Pandemic Bill is, so stop being a prig or explain yourself.

I'm guessing you won't be going clubbing at midnight tonight?

So the Bill Andrews wants in is beause the State of Emergency ends Mid December and then that means that all the Covid Laws and Restrictions are no longer allowed to happen - That Right?

That's right.

All the mandatory vaccination orders and any other restrictions cease and they have no power to put any new ones in place unless they get the Pandemic Bill up.

So that why lot of People want it to Fail so they can do what they want.

Problem with that people do stupid things and we could easily have a Big Spike of Covid Cases with the Unvaccinated

There is no explaining to be done. All legislation can be amended. The legislation has - as you put it - "a built in repeal date" until it doesn't.

I'm not being a prig - I'm politely telling you that the view you set out was incorrect. Of course, if you want to stick to it, I can't help that. If you want to pretend it doesn't matter, I can't help that, either.

However, it is the central plank of this post, dismissing the comments I had made in my immediately preceding post:

I don't see how pointing out that the legal premise of your post is wrong is "hair splitting".

You think Andrews is in a bind. I don't think he is. I think he can let the whole thing sail through and lay the blame at the feet of the opposition - the opposition plan was to whine loudly and ineffectually. They are now stuck with the fruits of their whining - because they are now able to block the legislation.

The problem is that Guy has been dog-whistling to the Right - but he actually doesn't agree with that view of the world. He thinks there should be continuing health restrictions, so unless he agrees to amending the existing legislation or allows the new legislation through, he's going to finish up unelectable.

It probably doesn't matter to much (he's already unelectable) but he could probably have reduced his losing margin if he'd thought this through a little more competently.

There is a cohort of people who want that, there is a larger cohort who think the proposed legislation gives too much power with no checks and balances. The latter group (including most of the cross bench) aren't against public health orders being made, they just think (as do I) that the first bill is a train wreck.
