What is Second Degree Harassment?

You can commit Second Degree Harassment in ways that you would think were far from criminal or illegal. According to NY PL 240.26, you are guilty this offense if you have the intent to harass, annoy or alarm some person and you:

1. Strike them in some manner or make physical contact with them (or attempt to do so).

2. Follow a person around in public areas; or

3. Engage in a course of conduct (repeated actions) of annoyance or alarm to that person without any legitimate reason to do so.

Seems like a big difference between 1 and 2/3. (Is this about De Goey, btw?)

I was being sarcastic! I’m really over the he’s just a lad shit! Oh he only got a $95 fine so it couldn’t have been that bad! He hired high priced lawyers that are famous for representing absolute scum! I wonder just how much it really cost him! None of us know what happened, but I thought it was pointy when it was his lawyer who got the case adjourned to view the footage. I don’t give a shit if someone was trying to steal his drink, there are other ways to handle it. I’m sure they have bouncers and CTV! It’s way past time for him to grow up.

I know you think it’s his off time etc, and I won’t even go into role models, cos clearly, he won’t ever be one, but his stupid drunken night has cost him training time, cost him concentrating on his game time, and you can bet your sweet arse it has cost him at least some level of trust of his fellow players..

He is very very well paid for his talents on the field. The club has weathered a couple of his storms now, and let’s face it, the only reason he didn’t want to come back this season tubby like he usually does, is because at the end of a year he is a free agent, and he wants mega bucks. Absolutely nothing to do with doing his best for Collingwood.

Let’s just see what he puts out. I honestly hope he has learnt from this and finally appreciates how damn lucky he is to have the talent he was born with, and the golden opportunity he has to set himself up for life financially, as well as you know, maybe win a premiership! I just wonder exactly how much the lawyers and probably pay offs have now cost him? It’s time to grow the **** up, he’s not a kid, he’s a grown man. I have zero respect for him right now, and yes I know he doesn’t care. But he should. No Magpie army, no soup for you!

I read a comment attributed to the judge, who said that the prosecution agreed to the plea deal to the lesser charge after they viewed the CCTV footage and it showed that what the complainant had alleged, didn't happen.

Hopefully this is his wake up call.
Every dead body on Mt Everest was once a highly motivated person, so maybe just calm the **** down.

“On or about October 30, 2021 at approximately 2.25 am... you, with intent to harass, annoy and alarm another individual subjected that person to physical contact and attempted and threatened to do the same, specifically struck another individual. Is that true?” Judge Marisol Martinez Alonso asked De Goey, as part of the plea process.

“Yes that is correct,” he replied.
