Pretty much. I'd say he'll be found guilty of something, whether it's classified as GBH or not, I have no idea.

Can't imagine he'd get time for it though?

Depends on whether the magistrate has the option of finding him guilty on a lesser charge than GBH?

Can't imagine you'd get away with just a good behaviour bond if found guilty of that but you may be right.

While it's hard to imagine a defence of self defence in this case being successful having been on the end of one punch in my life I can understand how Marley could have had a delayed reaction of shock and anger (assuming he was assaulted in the first place) which lead to him to his delayed retaliation to his attackers.

While I didn't retaliate I certainly felt violated and extremely angry in the minutes after being punched and faced with the same situation again I may respond differently just like Marley did.

I note the defence barrister is high profile Perth, QC Tom Percy. From reading the evidence in the paper Marley at least has opportunities for doubt to be placed on the prosecution's evidence:
- the victim and his friend were drunk as skunks so can their testimony be trusted?
- the CCTV footage is not completely clear
- there is no mention yet of any independent witness outside who was sober
- if Marley was attacked in the toilet and defence counsel can present a witness to that attack then that would discredit the victim's testimony. It would also help his argument he still felt under threat when he went outside.

More news from the second day of the trial. Seems Marley's brother was a witness outside and that it is becoming fairly obvious Marley was attacked by the same three men in the toilets who were then kicked out by the owner of the club. How the magistrate will able to know without reasonable doubt what happened around the time of the punch outside is hard to see. The footage is unclear apparently, the victim and his mate were smashed of their faces and then there is Marley's version of the story and also his brothers version.

And what charges have been laid against the three men who attacked him in the toilets. Are they all now innocent victims. Sounds like the police concerned only did part of their duties.

Not a bad effort having enough power in your non preferred hand to throw a punch that can break a jaw 4-5 months after a shoulder reconstruction. Shocked

What will / should go in his favour is his behaviour since the incident 14 months ago. His behaviour has been exemplary off field.

Found guilty of GBH, will be sentenced on the 28th (next Friday).
