Post subject: Abbott chief of staff gets away with drink drivingReply with quote

Now the party of law and order has won the election, it's a case of two sets of rules: One for the elite and their minions, and one for you and I.

I wonder what the response would've been if she was a member of powerless minority?

What a disgraceful lot of fraudulent hypocrites.

AAP via the SMH wrote:
Prime minister-elect Tony Abbott's chief-of-staff has escaped without a fine or driving licence suspension after admitting to low-range drink driving.

Peta Credlin, 42 returned a blood alcohol reading of .075 after being stopped while returning home in Canberra in the early hours of May 17, following Mr Abbott's budget reply speech to federal parliament.

She pleaded guilty and could have faced a fine of $500 plus a two-month driving suspension.

ACT Magistrate Maria Doogan found the charge proved but dismissed it without conviction, and imposed the standard $69 towards court costs.

That's just wrong.

A small fine and loss of license for a brief period.

Wasn't like she was facing the firing squad.

Sorry guys, what's the big deal here? Can you point out an instance of the double standard at work?

Drink-drive, lose your licence, David. End of story. That is the rule the rest of us live by. Different if you are one of Abbott's cronies, it seems. And it's not like she was only a little bit drunk - 0.75 is way over.

Is that a mandatory penalty?

Sorry to spoil the fun!

The countless men and women who face the same charge each and every day in our courts who walk away with a fine and loss of license as they should.

Of course most of them don't have a character reference from the attorney general and have to rely on some overworked duty solicitor.

Yes, but do you have evidence to show that this is the norm in such cases or that it's highly unusual for people to escape without a conviction for first-time offences?

Something to keep in mind is that the ACT generally has much more lenient rules than the states when it comes to driving infringements.

Specific to NSW and Canberra.

Quote:
In some cases a Court may decide not to impose any disqualification for 1st offenders, either due to the low blood alcohol reading involved, or the length of time the person has been driving (for example 20 years).

http://www.1800drinkdrive.com/drinkdrive.html

Also seems that 0.1 is the tipping point where they get serious. So a first offence with less than 0.1 and an otherwise good driving record could mean escaping without penalty or being given a restricted licence rather than a complete ban.

NSW always was soft on drink-drive. And guess what - they slaughtered lots more of themselves every year.
